VICSON- Charter

Name

English name: Vietnam Independent Civil Society Organizations Network (VICSON)

Goals:

1. Advocate, protect and exercise basic human rights enshrined in the Universal Declaration of Human Rights (1948) and other Conventions (Covenants) on human rights.
2. Encourage, support, and establish independent civil society organizations.
3. Implement properly the National Process to participate in the ASEAN CSOs Conference (ACSC) and the ASEAN People’s Forum (APF) as well as other international forums.

Membership

1. Any CSOs agreeing the Charter of VICSON and having two member organizations for introduction is eligible to become a member of the VICSON. The Secretariat will make a press release for the new membership after receiving an official letter from the candidate organization.
2. Members have the right to withdraw from VICSON after sending official notice to the Secretariat.

Secretariat

The secretariat consists of five people: two Co-Presidents (Co-Chairpersons) and three equal members, for a term of 02 years.

Each member organization has one vote to select 05 candidates for the Secretariat. The two candidates with the highest number of votes will become Co-Presidents. The three candidates with the next highest number of votes will become the other members of the Secretariat. When many candidates receive the same number of votes than two (for co-presidents) and three (for the Secretariat members), the representatives of the member organizations will make additional votes to select two presidents and three members of the Secretariat.

The tasks of the Co-Presidents: Responsible for all activities and development of VICSON.

Duties of other three members of the Secretariat: Supporting Co-President, and performing the tasks assigned by the Secretariat /VICSON.

When any member of the Secretariat could not permanently carry out his/her tasks, VICSON needs to conduct a meeting to select other member to replace him/her.

Regular Meetings, Extraordinary Meetings, Congress

VICSON holds monthly meeting (online or offline) with participation of representatives of all member organizations.

The Secretariat will hold extraordinary meetings when there are urgent issues to be settled.

Congress will be held for every two years.

Organizational Methods/Engagement Modality

– Openness: VICSON is a form of open forum for all civil society organizations.

– Diversity: member organizations represent the different groups of people in the country.

– Dialogue: discussions and dialogue as key means for understanding and development.

– Consensus: majority rule while respecting the differences of opinions.

– Non-violence: does not advocate the use of violence or incite to hatred.

Guiding Principles

– The process of democratization (democratic process): the principle of democratic process must be respected.

– Effective governance: approach the problem, consult and hold dialogue.

– Rule of law: advocated a rule of law.

– Non-discrimination: respect for the equality of all people regardless of ethnicity, religion, gender and other differences.

– Progress on human rights: no concessions on fundamental human rights standards and update progress on human rights in the world.

Dispute Settlement

In order to settle disputes between member organizations that affect activities and image of VICSON, the Secretariat will mediate the two sides based on Fairness and Solidarity.

Charter Amendments

This Charter can be amended if any member organization proposes. The proposal will be discussed at monthly meeting and the amendment (s) will be accepted if there is a consensus of the majority of two thirds of the member organizations on the issue.

Vietnam Independent Civil Society Organizations Network (VICSON)

Mục đích

1. Cổ xúy, bảo vệ và thực thi các tiêu chuẩn về quyền căn bản của con người trong Tuyên ngôn Quốc tế Nhân quyền (1948) và các Công ước (Covenant) quốc tế nhân quyền khác.
2. Khuyến khích, hỗ trợ, thành lập các tổ chức XHDS độc lập.
3. Thực hiện đúng đắn Tiến trình quốc gia (national process) để tham gia vào Hội nghị XHDS ASEAN (ACSC) và Diễn đàn Người dân ASEAN (APF) cũng như các diễn đàn quốc tế khác.

Thành viên

1. Bất cứ tổ chức XHDS nào chấp thuận Điều lệ của Mạng lưới XHDS này và có hai tổ chức thành viên giới thiệu thì có quyền tham gia. Ban Thư ký sẽ ra thông cáo báo chí về thành viên mới sau khi nhận được văn bản chính thức của tổ chức này.
2. Các thành viên có quyền rút tên ra khỏi Mạng lưới sau khi gửi văn bản chính thức đến Ban thư ký.

Ban thư ký (BTK) (Secretariat)

Ban thư ký gồm 05 người: hai vị Đồng Chủ tịch và ba ủy viên, với nhiệm kỳ 02 năm.

Mỗi tổ chức thành viên có một phiếu bầu để lựa chọn 05 ứng cử viên cho BTK. Hai ứng cử viên có số phiếu bầu cao nhất là hai vị Đồng Chủ tịch. Ba ứng cử viên có số phiếu bầu cao kế tiếp là các Ủy viên của BTK. Trường hợp đồng phiếu xảy ra với số lượng ứng cử viên đắc cử lớn hơn cơ cấu 02 chủ tịch hoặc 5 trong BTK thì các đại diện trong cuộc bầu cử sẽ biểu quyết để ra quyết định lựa chọn.

Nhiệm vụ của Đồng Chủ tịch: chịu trách nhiệm cao nhất về hoạt động và phát triển của Mạng lưới.

Nhiệm vụ của các Ủy viên: hỗ trợ cho Đồng Chủ tịch, thực hiện các nhiệm vụ mà Ban thư ký/Mạng lưới giao phó.

Trường hợp khiếm khuyết nhân sự trong BTK, thì cần có cuộc họp bất thường để bổ sung.

Họp định kỳ, họp bất thường, Đại hội toàn thể

Mỗi tháng một lần có phiên họp online hoặc offline của tất cả đại diện tổ chức thành viên.

BTK sẽ họp bất thường khi có vụ việc đặc biệt cần thảo luận.

Đại hội toàn thể thành viên sẽ họp hai năm một lần.

Phương thức tổ chức (Engagement Modality)

• Rộng mở: Mạng lưới là hình thức diễn đản mở để mời gọi mọi tổ chức XHDS tham gia.
• Đa dạng: các thành phần tổ chức XHDS khác nhau đại diện cho các tầng lớp nhân dân khác nhau ở mọi miền đất nước.
• Đối thoại: lấy trao đổi, thảo luận, đối thoại làm phương tiện cho sự thông hiểu và phát triển.
• Đồng thuận: nguyên tắc đa số và đồng thời tôn trọng các ý kiến khác biệt.
• Bất bạo động: không chủ trương sử dụng bạo lực hay kích động sự thù hằn.

Nguyên tắc định hướng (Guiding Principles)

• Quy trình dân chủ (democratic process): nguyên tắc về quy trình dân chủ phải được tôn trọng.
• Quản trị hiệu quả (good governance): tiếp cận vấn đề, tham khảo ý kiến và đối thoại.
• Pháp quyền (rule of law): chủ xướng một nhà nước pháp quyền, dựa vào quy định của pháp luật.
• Bất kỳ thị (non-discrimination): tôn trọng sự bình đẳng giữa mọi người bất kể dân tộc, tôn giáo, giới tính…
• Tiến bộ về nhân quyền: không nhượng bộ về tiêu chuẩn nhân quyền căn bản và cập nhật các tiến bộ về quyền con người trên thế giới.

Tài chánh

Mỗi tổ chức thành viên đóng góp cho Mạng lưới 200.000 đồng mỗi tháng (2,400,000 đồng một năm). Vận động các tổ chức thành viên có khả năng và các cá nhân/tổ chức khác hỗ trợ tài chánh cho Mạng lưới.

BTK đề cử một thủ quỹ phụ trách quản lý chi tiêu.

Tranh chấp

Trong trường hợp có tranh chấp, xung đột giữa các tổ chức thành viên mà ảnh hưởng đến các hoạt động của Mạng lưới, BTK sẽ tổ chức cuộc hòa giải một cách công minh (fairness) và trên tinh thần đoàn kết (solidarity).

Thay đổi Điều lệ

Điều lệ này có thể bổ sung, thay đổi nếu có sự đồng thuận của đa số 2/3 các tổ chức thành viên.
